1. SIA and SilkAir further reserve the right to modify the Registered Customer programme and its benefits and other features, including these Terms and Conditions at any time. This includes changes, without limitation, to the following:
a. Social media log in mechanisms;
b. SIA Group Websites; and
c. Partner airlines of the Registered Customer programme.
2. Although SIA and SilkAir (as the case may be depending on the entity with whom the Registered Customer account was created with) will use reasonable efforts to notify Registered Customers of material changes to the Registered Customer programme and/or to these Terms and Conditions, it is the responsibility of the Registered Customers to keep themselves up to date. Any continued use of the Registered Customer programme will be deemed as acceptance of any amendment.
3. SIA and SilkAir reserve the right to audit the Registered Customer’s account at any time for compliance with the Terms and Conditions without prior notice.
4. SIA and SilkAir reserve the right to terminate the Registered Customer programme or any part thereof, at any time and regardless of notice. SIA and SilkAir are not liable to any Registered Customer for any losses that may arise as a result of any changes to or the termination of the Registered Customer programme.
5. Should these Terms and Conditions be available in other languages, the meanings and interpretations of the English language version shall be final in the event of any discrepancy.
6. SIA and SilkAir reserve the right to interpret, apply and communicate the Terms and Conditions. All decisions made by SIA and SilkAir shall be final and conclusive in each case.
7. SIA and SilkAir may assign or deal with these Terms and Conditions in favour of any of its subsidiaries, subcontractors or appointed agents to carry out any of its obligations herein. SIA and SilkAir shall not be responsible to the Registered Customer for any delay in performance or non-performance of its subcontractors and/or agents due to causes beyond its reasonable control.
8. Each of SIA and SilkAir shall not be in breach of its obligation of confidentiality if disclosure of a Registered Customer's confidential information is pursued in conjunction with an order of court, or is required by law or any governmental or regulatory authority. However, if the disclosure is not required with immediate effect, each of SIA and SilkAir shall give the Registered Customer prior notice of such disclosure, to the extent permitted by law.
9. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any unresolved dispute arising under, out of, or in connection with these Terms and Conditions, including any questions regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force.
